Colorado Department of Public Health and Environment Files Motion to Dismiss Sheep Mountain Alliance Lawsuit Challenging License Approval for Energy Fuels’ Piñon Ridge Uranium Mill

Energy Fuels Inc. (TSX-EFR) (“Energy Fuels” or the “Company“), Energy Fuels Inc. (TSX-EFR) (“Energy Fuels” or the “Company”), an advanced uranium and vanadium development company, earlier announced that Sheep Mountain Alliance based in Telluride, Colorado had filed suit in District Court, City and County of Denver, Colorado, naming the Colorado Department of Public Health and Environment (CDPHE) as Defendant, and Energy Fuels’ Colorado subsidiary, Energy Fuels Resources Corp. as an Indispensible Party.

CDPHE today filed a comprehensive Motion to Dismiss Sheep Mountain Alliance’s lawsuit (Sheep Mountain Alliance vs. CDPHE) challenging CDPHE’s license approval granted on January 5, to Energy Fuels Resources to construct and operate the Piñon Ridge uranium mill near Naturita, Colorado. In its Motion to Dismiss, CDPHE argues that Sheep Mountain’s complaint fails to state any claim over which the Denver District Court has jurisdiction to grant relief. Moreover, CDPHE argues that Sheep Mountain lacks standing to sue the State regarding this license decision because SMA has failed to show an injury in fact to any interest protected by law.
